Data Protection Act
Under this Act you are entitiled to have
access to your records.
Data that has been anonymised, such that patients cannot in any way be identified, may be used by the practice and other clinical organisations for research purposes without seeking further consent.
Any requests for patient information made by a third party outside the practice is treated in accordance with the following principles:
• The identity and authority of the caller must be verified e.g. using call back procedures
• The requirement for the data transfer must be justified in accordance with the Caldicott Principles and Data Protection Act 1998
• Patient permission to divulge information must already be in evidence or there is an over-riding requirement to release information in accordance with current legislation
• Where there are doubts regarding the legitimacy of a request, approval from the Caldicott Guardian/IM&T Lead should be sought.
Dr Higginson is the IM&T Lead for the 2 practices in Wellington Square and Dr Hughes is the Caldicott Gaurdian.
